1. Our Services
We provide IT and digital marketing services, including but not limited to Website Development, API & Backend Solutions, Scalable Architecture, SEO Optimization, Social Media Management, Graphic Design, and Meta Ads & Performance Marketing. The specific scope, deliverables, and cost of each project will be confirmed in a written proposal or agreement before work begins.
2. Client Responsibilities
- Provide accurate, complete, and timely information, content, and access needed to complete your project.
- Review and respond to drafts, milestones, and requests for feedback within a reasonable time to avoid project delays.
- Ensure you have the rights to any content, images, or materials you provide to us for use in your project.
3. Payment Terms
- Project-based work is typically billed via an upfront deposit and milestone payments, as agreed in your proposal.
- Recurring services (SEO, social media, ad management) are billed on a monthly basis in advance.
- Late payments may result in a pause of services until the account is brought current.
- All fees are exclusive of applicable taxes unless stated otherwise.
4. Intellectual Property
- Upon full and final payment, ownership of the final agreed deliverables (e.g. website files, designs) transfers to the client, except for any third-party assets, tools, or licensed software used, which remain subject to their own licenses.
- We retain the right to showcase completed work in our portfolio, case studies, and marketing materials, unless otherwise agreed in writing.
- Any pre-existing tools, frameworks, or code libraries we use remain our property or that of their respective owners.
5. Project Timelines & Revisions
Estimated timelines are provided at the start of a project and depend on timely client feedback and content delivery. A reasonable number of revisions are included as agreed in your proposal; additional revisions beyond that scope may be billed separately.
6. Third-Party Platforms
Where our services involve third-party platforms (such as Meta, Google, hosting providers, or domain registrars), your use of those platforms is also governed by their own terms and policies. We are not responsible for outages, policy changes, or account actions taken by these third parties.
7. Confidentiality
We treat all client information and project materials as confidential and will not share them with third parties except as necessary to deliver the agreed services or as required by law.
8. Limitation of Liability
To the fullest extent permitted by law, Evolution Media Tech is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim will not exceed the amount paid by the client for the specific service giving rise to the claim.
9. Termination
Either party may terminate an ongoing service agreement with written notice, as specified in your service agreement. Fees for work completed up to the termination date remain payable.
10. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles, unless otherwise agreed in writing for a specific client engagement.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
